Terms of Service
These terms apply to the websites Toppages builds, hosts and looks after, and to the dashboard you use to keep yours up to date. By asking us to build a site, or by signing in to the dashboard, you agree to them.
What we provide
We design and build a website for your business, publish it on a domain, host it, keep the software behind it patched, and give you a dashboard where you can change your own words, prices, products and posts without waiting on us. What is included in your particular arrangement — the number of pages, whether we register the domain, what we will edit for you — is whatever we agreed with you in writing.
Your account
Keep your sign-in details to yourself, and tell us promptly if you think someone else has them. Anything done from your account is treated as done by you. If you invite staff, you are responsible for what they publish. Ask us to remove their access when they leave.
Your content stays yours
The words, photographs, logos, prices and posts you put on your site remain yours. You give us permission to store them, adapt them for different screen sizes and formats, and publish them on your site and — where you have asked to be listed — in our directory. That permission exists only so we can run the service, and it ends when your site comes down.
You confirm that you are entitled to publish what you upload: that the photographs are yours or licensed to you, that the claims are ones you can stand behind, and that the business details are accurate.
What must not go on the site
Nothing unlawful, nothing that infringes someone else's rights, nothing deliberately misleading about what you sell, and nothing designed to harass or defraud a visitor. We do not review every change you publish, but we will act on anything we become aware of.
Domains
Your site runs on your own domain. Where we register or renew one on your behalf, we do so for you and will transfer it to you on request once anything owed for it is paid. Where you already own the domain, you keep it and simply point it at us.
Fees
Fees, the billing period and what happens at renewal are set out in the arrangement we agreed with you. We will tell you before a price changes. If an invoice goes unpaid we will contact you first; continued non-payment can lead to the site being suspended.
Availability
We work to keep your site online and fast, but no website is available every second of the year. Maintenance happens, upstream providers have outages, and networks fail. We do not promise uninterrupted service, and we will keep planned interruptions short and, where we can, outside your business hours.
Ending the arrangement
You can stop at any time, with notice as agreed. We may suspend or end the service if fees go unpaid, if the site is being used for something in the list above, or if we are required to. When the arrangement ends we will give you a copy of your own content and a reasonable window to move your domain before anything is deleted.
Liability
We are responsible for running the service with reasonable care and skill. We are not responsible for losses we could not have reasonably foreseen, for business you believe you lost while the site was unavailable, or for content you chose to publish. Nothing here limits liability that cannot lawfully be limited.
Changes to these terms
We may update this page as the service changes. If a change materially affects what you are paying for, we will tell you rather than leaving you to notice.
